Can you appeal SSDI denials in New Mexico?

Yes — if your Social Security Disability Insurance (SSDI) application is denied in New Mexico, you have the right to appeal. Since most initial claims are denied, understanding the appeals process is critical to improving your chances of eventually receiving benefits.

Find out if you qualify for SSDI benefits. Pre-qualify in 60 seconds for up to $4,018 per month and 12 months back pay.

Please answer a few questions to help us determine your eligibility.

Step 1: Request for Reconsideration
  • The first step in appealing is filing a Request for Reconsideration.
  • Another examiner (different from the one who issued the denial) will review your case.
  • You can submit new medical evidence or updated records to strengthen your claim.
  • This request must be filed within 60 days of receiving your denial letter.

Step 2: Hearing Before an Administrative Law Judge (ALJ)
  • If reconsideration is denied, you can request a hearing with an ALJ.
  • Hearings are usually held at New Mexico’s Office of Hearings Operations (OHO) or sometimes by video.
  • You’ll have the chance to explain your condition, present evidence, and even call witnesses.
  • The judge may also question medical or vocational experts about your ability to work.

Step 3: Appeals Council Review
  • If the ALJ denies your case, you can ask the SSA Appeals Council to review it.
  • The Appeals Council can affirm, reverse, or send your case back for another hearing.
  • This stage often takes several months.

Step 4: Federal Court Review
  • If the Appeals Council upholds the denial, your last option is filing a lawsuit in U.S. District Court.
  • This takes the case outside the SSA system and into the federal courts.
  • At this stage, having an experienced SSDI lawyer is highly recommended.

Why Filing an Appeal Is Important
  • Most denials are overturned only after an appeal, not during the first application.
  • Each step gives you the chance to add new medical documentation.
  • Missing appeal deadlines (usually 60 days) means starting the process over.
